1. Introduction
Welcome to Psychotherapy Now (“Platform”). These Terms of Use govern your access to and use of the Platform. By accessing or using the Platform, you agree to be bound by these Terms. This Platform is intended exclusively for use by licensed mental health professionals.
2. Nature of the Platform
Psychotherapy Now is an AI-assisted interface designed to support licensed clinicians in professional training, reflective exercises, and supervised clinical interactions.
The Platform is a tool. It is not a provider of psychotherapy or medical care and does not deliver treatment, diagnosis, or clinical services. All outputs generated by the Platform are automated, informational, and non-clinical in nature.
3. Eligibility
You may use the Platform only if you are a licensed mental health professional, provide accurate licensure and identity verification, and agree to these Terms. Use by unlicensed individuals or independent patient use is strictly prohibited.
4. Permitted Uses
4.1 Supervised Patient Use
You may use the Platform in connection with a patient only when you are present in real time and maintain full control of the interaction.
4.2 Professional Training
You may use the Platform for skill development, technique exploration, and simulation of clinical scenarios.
4.3 Self-Reflective Use
You may use the Platform for self-reflective professional exercises, subject to the terms of Section 5.
5. Self-Reflective Use and Role-Play
You may use the Platform in a self-directed manner, including role-playing as a patient and prompting the AI to respond as a therapist.
5.1 Definition
All such use is defined as self-directed reflective simulation. It is not therapy, treatment, or clinical care.
5.2 No Therapeutic Relationship
Use of the Platform does not create a therapist-patient relationship, a clinical relationship, or any duty of care.
5.3 Your Responsibility
You agree that you are not receiving therapy from the Platform, that you remain fully responsible for your own well-being, and that you are responsible for how you interpret and use all outputs.
5.4 Not a Substitute for Care
The Platform is not a substitute for psychotherapy, supervision, consultation, or medical or mental health treatment.
6. No Clinical Services Provided
The Platform does not diagnose, treat, assess risk, or provide clinical recommendations. All outputs are generated by an artificial system and do not constitute professional advice.
7. Use With Patients
If you use the Platform in connection with a patient, you must be present at all times, you must maintain full control of the interaction, and you assume full clinical and legal responsibility. The Platform functions only as an adjunct tool.
8. Data and Privacy
The Platform is designed to minimize data retention. No storage of session transcripts is intended, no retention of protected health information (PHI) is intended, and only limited operational metadata may be retained. You are responsible for ensuring compliance with HIPAA, state laws, and professional standards.
9. Professional Responsibility
You acknowledge and agree that you remain the responsible licensed professional, retain full authority over all decisions, and that the Platform does not replace your judgment.
10. Limitation of Liability
To the fullest extent permitted by law, the Platform and its operators shall not be liable for decisions you make, reliance on AI-generated content, or outcomes resulting from use. All responsibility remains with you.
11. Indemnification
You agree to indemnify and hold harmless the Platform and its operators from any claims arising out of your use of the Platform, your clinical activities, or your interpretation of outputs.
12. No Warranties
The Platform is provided “as is” and “as available.” No warranties are made regarding accuracy, reliability, or clinical usefulness.
13. Incorporation of Additional Policies
You acknowledge that additional documents are incorporated into these Terms, including the Psychotherapy Now Legal and Compliance Binder, Therapist Agreement, and operational and safety policies. These documents are binding and form part of these Terms.
14. Termination
Access may be suspended or terminated if these Terms are violated, licensure is invalid or unverifiable, or misuse of the Platform is detected.
15. Governing Law
These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles.
16. Acceptance
By using the Platform, you confirm that you have read and understood these Terms, agree to be bound by them, and accept full professional responsibility.
